Background Check & What happens if Visa rejected?

I have an atypical situation regarding my Z visa was hoping to get some opinions from people more experienced in the visa process.

 

I have a DUI from a year and a half ago that is suspended imposition of sentence, which means that it drops off my record this June and won't show up on my criminal background check after that.  The problem is that I accepted a job in Hangzhou and my employer is asking for a "No criminal Record" form.  Unfortunately, the DUI will still show up until June and although I was hoping to be working by March.

 

My questions are:

1) Will I have any chance of getting a z-visa to start working with this blemish on my record?

 

2) If I DO apply and the visa gets rejected will that bar me from applying for another work visa in June?

 

Where I am at right now is that I want to take the job offer, but don't know if it will even be possible to secure a visa.  Would it be more prudent to just wait until this summer and apply for a visa to the upcoming academic term in August once my record is clean?  Any advice is helpful.

I actually really want this job so much that I am just going to submit it to him and see if we cant get some guanxi going.  If not, there is no major issue (except if he is short a teacher which I apologize for, but how was I supposed to know the required forms for the city. There is no clear requirement outlined by each province I could find).  I already know Japanese and could do a crash course in Korean... if China wants to deny me i guess i can work around it in June (probably could go to old digs...).  If they want to blacklist me than I can easily get a gig at a more developed country that pays more so why should I delay?  Reason I want to go to China is purely for my future potential so why should I delay? I could honestly pay off my college debt way faster in Korea if i wait til June.  I guess it might be a gamble, but I really want don't want to just tell my potential employer I am wussing out when we are both already taking a tremendous chance on each other.  All I can do is trust in him and vice a versa.  (I guess those are my thoughts as of today)

There's rejections, and there's rejections. If the employer or an official just takes one look at your application, notices the problem, then tells you not to even bother, you've not technically applied and therefore not technically been rejected. 

 

If your documents go over the desk, entered into the system, and then you're rejected, that'll be recorded. You'd need to declare that rejection on future applications and that'll either invite extra scrutiny or just an outright no. 

 

Under the circumstances - good luck, let us know what happens.

I have to say I don't think that's a wise move.

Maybe you'll get rejected and maybe not. But if there is a problem, then you'll very likely see China become an off-limits destination for the foreseeable future.

It's only a few months. Good jobs for good teachers are not that scarce in China. I'd strongly suggest you hold your horses on this.

By the way, I assume but don't know that a short criminal record is more a problem for a teaching job than a commercial position

Update time! ... you people are totally right.  I was over enthused about the job (hell i deserve to be) ... My employer says that all you need for visa in hangzhou is no convictions ... which i do have any way you put it... its sketch however and considering the stuff I have read about the chinese consulate i don't want to risk it if i don't have to. 

 

I will go to consulate and ask if a local check is sufficient.  I can get the no convictions stamp on every form ever made by god . but its that DUI charge that i am scared about.  Technically, I shouldnt have an issue getting the visa is what my boss says.  Going to consulate this week so wish me luck.

 

technically i should get dat visa though i dont want to get technical .. i just want the visa...
