Their service sounds good to me, internship + language course, actually exactly what I am looking for...

Hi Ben,

Could you provide a clarification over the use of an advert (please see attached) used for advertising your programme?

I am a former ChinesePod user, so am familiar with their advertisement. When I visited Chinese-Forums the other day, the attached advert appeared. I immediately assumed it was the ChinesePod advert - until I looked closely and noticed that Getin2China was pasted across the advertisement where I would normally expect to see the ChinesePod logo.

My immediate reaction was whether or not there is any copyright infringement i.e. do ChinesePod have exclusive rights to this image? I'm sure you can understand that it would appear at first glance that Getin2China have 'borrowed' the advertisement and pasted over their logo.

For reference, Getin2china are not a direct advertiser with us, their ads appear via the Google Adwords program.

Hi Again,

What you can see on that picture is a face of an asian girl and the website address as well as service that we are providing. The GoogleAds approved our Ads as well as Chinese Pod ads. Chinese Pod have a similar ad to our and of course there is no any copyright to such picture.

Thanks for the clarification.

The "asian girl" is the girl whom I associate with ChinesePod, especially as I used to see her at least twice a day (on my iPhone) when listening to ChinesePod during my commute to work for around a year ;) I would also say that you have a similar ad to ChinesePod, since ChinesePod have been using that particular image for a couple of years.

That said, I'm surprised at their [ChinesePod's] commercial naviety, because I associate the image as part of their brand - as well as their logo. To use an image to help build brand recognition, and then not to have exclusive rights to that image, strikes me as an own-goal.

Appreciate the clarification, Ben. My interest is not only as a Chinese student (studying in Kunming), but also a professional interest as my field is in Supply Chain Management; hence the interest in copyright and branding - as well as commercial exploitation (and value) of one's brand.

I'd be wary of putting too much faith in a business license. While it's an indication that a company is to a certain extent established (they have an address and a certain amount of capital) it doesn't necessarily mean they're any good at what they're doing. I can think of plenty of restaurants with business license, tax certificate and hygiene whatsit hanging on the wall that I don't particularly want to eat at again. Similarly a few photos and youtube videos aren't of a huge amount of value. And the business license is quite likely to be in a completely different name to the website you're dealing with - you can't register an English company name in China. I think.

As for how you can choose a trustworthy company - good damned luck, it's a minefield. Any company's own website needs to obviously be taken with a pinch of salt. Testimonials on the Internet might be useful indicators, but many are faked. Similarly many complaints are from customers that frankly had unrealistic expectations in the first place.

I kind of feel sorry for the legitimate firms out there. . .

Re: the picture. It may be a stock photo, but that's a hell of a stroke of bad luck to use the exact same one as the most recognizable Chinese learning product out there. The sooner that ad gets pulled the better.

Just wanted to say that we also had some of our content copied and used by Getin2China several times.

They also used our registered trademark in their Adwords campaign. Glad you noticed their tiny business license scan - could be anything!

We have no evidence of anyone independently verifying they had a good time on one of the Getin2china programs, so who knows?

I wouldn't go on a program with them personally, but of course I'd say that!
