I was hoping to find out if it would be correct that if you were caught smuggling illegal tobacco in China then you can receive 10 years in prison and you would have to pay 50,000 yuan fine per month to get out of prison and serve the sentence in your home.

My gf is a lawyer , I'll ask her to look up the criminal code when she gets back. 


She says yes can  get more than ten years . Highly depends on circumstances naturally, I.e shoving a 100 packs  in your bag to bring i through the airport from full scale smuggling operating . More details needed.


A quick scan of the criminal code suggests it's based off what tarrif you should have paid (smuggling goods act)



Others factors too such as your position in the operation, nature of the product, e.g baby milk powder , dangerous material She hasn't seen anything that says you can have home detention but didn't have time to go throw the code.

She always stresses that chinese law has a lot of scope for interpretation and a lot of "catch all" elements . It changes regularly much to the frustrating of students who fail exams and are faced with a big change to the syllabus in the repeat exams.
